1.Acceptance of terms

These Terms of Service ("Terms") are a legal agreement between you and Invitely ("we", "us", or "our") governing your access to and use of our website and digital invitation services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2.The service

Invitely lets you create, send, and manage digital invitations, collect RSVPs, manage guest lists, check guests in, share event photos, and view related analytics. We may add, change, or remove features at any time.

3.Accounts and eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4.Acceptable use

You agree not to misuse the Service. In particular, you will not:

  • Send spam, unsolicited messages, or invitations to people who have not agreed to be contacted by you.
  • Upload content that is unlawful, infringing, defamatory, hateful, or that violates the privacy or rights of others.
  • Attempt to access, disrupt, or compromise the Service, its infrastructure, or other users' data.
  • Reverse engineer, resell, or use the Service to build a competing product, except as permitted by law.

5.Your content

You retain ownership of the content you create or upload, including invitation details and images. You grant us a limited license to host, store, display, and process that content solely to operate and improve the Service. You are responsible for ensuring you have the rights to any content you upload, including guest data you collect.

6.Payments and refunds

Paid packages and add-ons are billed through our payment processor, Stripe. Prices are shown at checkout and may vary by region and currency. Unless required by law or stated otherwise at the time of purchase, payments are non-refundable once the associated package has been activated. You authorize us and Stripe to charge your chosen payment method for the amounts you agree to.

7.Third-party services

The Service relies on third parties such as Supabase, Stripe, and Resend. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

8.Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9.Limitation of liability

To the maximum extent permitted by law, Invitely and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

10.Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a risk to the Service or others. Provisions that by their nature should survive termination will do so.

11.Changes to these terms

We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12.Governing law

These Terms are governed by the laws of the jurisdiction in which Invitely operates, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless applicable law requires otherwise.
